1. Payment - Payment must be made in full at the time of purchase. Refunds will only be considered within 24 hours of the purchase date. NOTE:  Self Paced Module program purchases are final. There are no refunds for the self paced module program.  Also, no refunds will be given if the student has taken any of the courses within the program after signing up for the live, instructor led courses.   If a refund is awarded, Code3 CME will withhold 15% to cover administrative costs associated with your credit card purchase. All additional materials (e.g. E-book) are NON REFUNDABLE and will not be included in the refund amount  If a refund is awarded, the amount (minus 15% and additional materials if applicable) will be credited back to your credit card institution within 7 – 10  business days. Payment includes electronic copies of course materials necessary to take all CME Course Modules included in the CME Courses, including electronic copies of all course materials (including any CME books), access to the course site, and, submission of your successful completion of the full CME Course to the state accreditation body that you request information be sent to when you have purchased the Instructor-led CME Course, or, in the case of Self-paced CME Courses, upon completion of any purchased Self-paced CME Course.  Th

2. Service - is an interactive website where users can obtain CME credit by taking scheduled classes (“CME Courses”) on the Site (“Service”). However, the Service includes all aspects of, including but not limited to all products, software, and services offered via the Site.

3. Site Features - shall have the right at any time to change or discontinue any aspect or feature of, including, but not limited to, content, hours of availability, the cost of the CME Courses and/or Service, the addition of user content areas, and equipment needed for access or use. Further, may request additional information at any time by you to update or enhance account information collected for use of the Site and or to provide the Service. This includes requesting more information if it is required by your state accrediting agency to submit your CME credits to such agency.

You acknowledge that all posts made on this Site are public and not private communications and that others may read your posts without your knowledge. Additionally, as a member of you may automatically be signed up to receive our newsletter. 6. Accounts - In order to access some features of the Service, you will have to create a account (“Account”). You may never use another’s Account without permission. When creating your Account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your Account, and you must keep your Account password secure. You must notify immediately of any breach of security or unauthorized use of your Account. Although will not be liable for your losses caused by any unauthorized use of your Account, you may be liable for the losses of or others due to unauthorized use. In order to protect yourself and other users of the Site, the following terms must be followed: (a) You will not create an Account for anyone other than yourself or your business without permission, (b) If we disable your Account, you will not create another one without our permission, (c) You will keep your contact information accurate and up-to-date, (d) You will not transfer your Account to anyone without first getting our written permission, and (e) If you select a username for your Account we reserve the right to remove or reclaim it if we believe appropriate (such as when as trademark owner complains about a username that does not closely relate to a user’s actual name).

CME Courses and the Service

7. CME Course Accreditation - Unless otherwise stated at the time of purchase, all CME Courses available through are accredited for all fifty US states and the District of Columbia. To receive credit for all Self-paced CME Courses, you must successfully complete the Self-paced CME Course that you purchased. To receive credit for all Instructor-led CME Courses, you must successfully complete all the classes in the series (the “Modules”) for the Instructor-led CME Courses listed at the time of purchase (which may be modified by Code3 if required by state accreditation).

8. Start Date - For all Instructor-led CME Courses, all Modules in your Instructor-led CME Courses must be completed within two years of purchase to receive accreditation. For all Self-paced CME Courses, including those that OSHA credit is available, all modules in your Self-paced CME Courses must be completed within one year of purchase to receive accreditation.

9. Activity - For Instructor-led CME Courses, you must complete the Activity associated with each module for the CME Course prior to taking the Instructor-led portion of the CME Course Module. Failure to complete the Activity will result in the inability to register for an Instructor-led CME Course Module.

10. Instructor Led Courses - Instructor-led CME Modules are available as scheduled. Class space is limited so you must sign in as soon as registration opens (typically 15 minutes prior to the CME Module) to ensure a spot in the CME Module. However, registration in the CME is not guaranteed if the CME Module reaches it maximum student limit at any time. If spaces are available, you may register up to 10 minutes after a CME Module begins. Registration for Instructor-led CME Classes will be unavailable ten minutes after the scheduled start time due to accreditation requirements.

10a.  Student Participation - In order to maintain compliance with Code3 CME's virtual accreditation through CAPCE, each student must actively interact with the instruct and other students during each module/class.  This includes but is not limited to answering polling questions, answering quiz questions, and providing feedback when called upon by the Instructor.  If the student fails to interact with the Instructor, he or she will be considered to be in non-attendance and will be removed from the classroom.  If an Instructor removes a student from the class, the student will be required to repeat the class/module during the next offering.

11. Testing - You will be given a Testing Code at the end of each Instructor-led CME Module. You must have the Testing Code in order to take the test associated with the Instructor-led CME Course Module. You will be given three attempts to take the test to receive a passing score. If you are unable to receive a passing score within three attempts, you may retake the Instructor-led CME Course Module one additional time. You will receive one additional attempt to retake the test after retaking the Instructor-led CME Course Module. If you are unable to pass the test after retaking the Instructor-led CME Course Module on your first attempt, then you will be required to retake such Module at an additional expense in order to complete your CME Course.

12. No Code - If you have taken the Instructor-led CME Module but were not in the Module when the code was given, you must retake the Instructor-led CME Module to receive the Code. You will be able to take the Instructor-led CME Module one additional time to receive the Testing Code without additional charges.

13. Self-Paced Courses - Self-paced CME Courses are available twenty-four hours a day, seven days a week except during schedule maintenance and emergency downtimes. You must complete the Self-paced Course and any associated Activities and/or Testing in order to receive you accreditation.

14. Accreditation - For Instructor-led CME Courses, you will receive credit for such CME Courses upon successful completion of all the modules in your CME Course within two business days (provided, however, that processing times of receiving notification of such completion may vary from state to state). Upon successful completion of all Modules, will notify your state accreditation entity that you have completed the full CME Course and will report you passed the CME Course. For Selfpaced CME Courses, you will receive credit for such CME Courses upon successful completion of all any self-paced CME Course within two business days (provided, however, that processing times of receiving notification of such completion may vary from state to state).

Intellectual Property Issues

15. Your Content and Information - While you retain ownership of all the content you post on the Site, including comments, questions, and information during CME Courses, by posting content on the Site, you shall be deemed to have granted to a royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, publish, edit, translate, distribute, perform, advertise with, and display the communication alone or as part of other works in any form, media, or technology whether now known or hereafter developed, and to sublicense such rights through multiple tiers of sublicensees. You further agree that any Content you submit to the Service will not contain third-party copyrighted material, or material that is subject to other third-party proprietary rights, unless you have permission from the rightful owner of the material or you are otherwise legally entitled to post the material and to grant all of the license rights granted herein.

16. Third-Party Sites - The Site may contain links to other website ("Third Party Sites") as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, or items belonging to or originating from third parties (the "Third Party Content"). Such Third Party Sites and Third Party Content are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by is not responsible for any Third Party Sites accessed through the Site or any content posted by other users of the Site.
